National Council of Statistics – CNEST

Law No. 35 / VII / 2009 of March 2, Law of the National Statistical System, defined as bodies of the National Statistical System, the National Council of Statistics, the National Institute of Statistics, the Bank of Cape Verde and INE delegate bodies.

The aforementioned law gives the National Council of Statistics features the state body that presides over and coordinates the National Statistical System, with a suitable composition and powers of the responsibilities assigned to itand they should be dignified and its functionality and operability ensured.

Composed of representatives of the State Administration sectors, the Bank of Cabo Verde, the National Association of Municipalities, the private business sector, trade union associations, orders and professional associations, environmental associations, non-governmental organizations, the academia and independent persons, the National Statistical Council is accorded significant powers of deliberative and consultative nature, highlighting among others those relating to the definition of the General Guidelines of National Statistical Activity and their priorities in the medium term.

The CNEST is the state agency that presides over and coordinates the National Statistical System.

While agglutinative body of producers and users of statistical information, the CNEST sets guidelines for statistical activities through the general national statistical activity and statistical work programs, thus exercising, coordination by objectives. It also holds the methodological coordination, approving, concepts, definitions, classifications and other technical coordination instruments.

  1. In accordance with Articles 16 and 17 of Law No. 35 / VII / 2009, CNEST is chaired by a recognized scientific merit and professional personality and for his/her integrity and independence nominated by the Council of Ministers, on a proposal of the Prime Minister with a mandate for 3 years, renewable for one or more times for the same period, being composed of the following:

a) The President of INE, acting as vice president;

b) A representative of the Bank of Cabo Verde;

c) A representative of each ministry that has INE delegate bodies;

d) A representative of each Ministry, other than those mentioned in the previous paragraph, a maximum of 5, considered a major user of official statistics by INE by proposal to the Prime Minister;

e) A representative of the National Association of Municipalities;

f) Two representatives of the private business sector;

g) Two representatives of trade unions;

h) Three representatives of professional associations;

i) A representative of journalists’ associations;

j) A representative of consumer associations;

k) A representative of environmental associations;

l) A representative of non-governmental organizations;

m) Two University Teachers from the statistical and econometric methods fields or related areas;

n) Two individuals of recognized reputation for scientific merit, integrity and independence.

2. The permanent members, together with their alternates shall be appointed by order of the Prime Minister as follows:

ã) The members of subparagraphs b) to l) of paragraph 1, a proposal by the Ministers and entities;

b) The members of paragraphs m) and n) of paragraph 1, a proposal of the President of INE.

3. The alternate members of INE are appointed under subparagraph b) above.

4. The members referred to in subparagraphs b) to l) of paragraph 1 shall be proposed by the respective Ministers and entities from officials or agents with the highest possible position in its macrostructure.

5. CNEST has a secretary, without voting rights, appointed by proposal of the President of INE from the superior staff of the Institute.

Under Article 18 of Law No. 35 / VII / 2009, CNEST has the following skills:

  1. To define the general guidelines of the official statistical activities and establish their priorities, in a medium term perspective;
  2. To approve, upon proposal by the INE, a code of ethics of the professional official statistics and to ensure their effective implementation;
  3. To issue an opinion on the draft annual and multi-annual plans of activities of Official Statistics Producers (OPES) and their budgets and their final reports, which will be presented in an integrated manner under the coordination of INE, to be submitted for approval of the respective supervisory Government members
  1. Aprovar a adequação dos planos referidos na alínea anterior às dotações orçamentais efectivamente alocadas mediante proposta do INE atentas as prioridades fixadas nos termos da alínea a);
  1. To approve the adequacy of the plans referred to in the previous paragraph to the budgetary appropriations actually allocated by INE by proposal taking into account the priorities set under point a);
  2. To approve a proposal from INE, the technical tools for statistical coordination, concepts, definitions and nomenclatures, the mandatory use by OPES, the possibility of proposing to the Government extends this imperative use to the Public Administration;
  3. To promote the effectiveness of the use by NSA official administrative data for statistical purposes, including personal data, making recommendations to the Government aimed at strengtheningaccess INE’s acession to administrative data, and participation in the design of application forms and supporting records to ensure the adoption of definitions, concepts and nomenclatures approved by CNEST;
  4. Set a proposal from INE, other individual auxiliary information in addition to those considered in paragraph e) of paragraph 2 of Article 2 of Law No. 35 / VII / 2009;
  5. Ensure compliance with the principle of statistical confidentiality, approving, upon proposal by the INE, the regulation of its implementation by OPES, and decide on applications for statistical confidentiality waiver in accordance with paragraphs 5 to 8 of Article 10 of the law No. 35 / VII / 2009;
  6. Issue an opinion on the proposals of the NSA creation of Delegates bodies and the cessation of its powers under Article 30 of Law No. 35 / VII / 2009;
  7. To advise on the draft annual program of statistical cooperation OPES and funding aimed at their integration;
  8.  To propose to the Prime Minister to carry out external technical audits to OPES on the quality of their produced official statistics;
  9. To make recommendations to the Government on legal commands and on the rules and principles that should govern the design, production and dissemination of official statistics;
  10. To prepare a report every three years on the evaluation of National Statistical System status with the reasoned proposals for measures to be taken and submit to the Government;
  11. To present biennially to the National Assembly a report on the enforcement of the National Statistical System, focusing on any checked constraints;
  12. To adopt its rules of procedure.

Under Article 19 of Law No. 35 / VII / 2009:

  1. CNEST normally meets twice a year and extraordinarily whenever called by the President, in terms to be laid down in its rules.
  2. CNEST can create sections for areas of matter, pursuant to the terms laid down in its rules of procedure.
  1. The President of CNEST can invite other representatives of national, public or private entities, as well as foreign and international entities to attend meetings, without voting rights,
  2. CNEST can gauge the opinion of legal experts on the issues it deems relevant to the performance of their duties.
  1. CNEST may decide, case by case, the publication in the Official Gazette of its deliberations that are of major public interest.
  1. The National Statistical Council shall meet in plenary twice a year by its President initiative.
  1. It may also hold extraordinary meetings in plenary or restricted sections, permanent or temporary, depending on the subject adressed, at the initiative of the President or at the request of one third of its members.
  2. The decisions of the National Statistics Council are published in the Official Gazette.
  3. The National Statistical Council can gauge the opinion of experts on the issues it deems relevant to the performance of its functions and may be assisted by technicians of public services or private entities.
  4.  At the end of each term, the National Statistical Council shall prepare a report evaluating the National Statistical System status.
